A scientific paper by Attorney Emanuil Damyanov Kolev, entitled “Inapplicability of the Suspension of Register Proceedings in the Hypothesis of Article 223a of the Commercial Act,” has been published in the Liber amicorum in memory of Professor Dimitar Silianovski, Professor Zhivko Stalev, and Professor Vitali Tadzer.

The paper analyzes both the general prerequisites for suspending register proceedings and the specific hypothesis of suspending the procedure for announcing a list of agenda items for a general meeting that has already been convened under Article 223a of the Bulgarian Commercial Act. A detailed examination is provided of a series of cases from 2014 concerning the suspension of proceedings for announcing agenda items at the general meeting of the public joint-stock company “Bulgartabak Holding” AD, illustrating numerous controversial issues related to the analyzed problem.
