In issue 5/2024 of the Bulgarian Bar Review journal, you can find attorney Emanuil Damyanov Kolev’s paper on “Inheritance and Co-ownership of Shares: Exercise of Collective Shareholder Rights in Inheritance.”
The paper examines a number of important issues related to share inheritance and the exercise of membership rights by heirs. The court practice in Bulgaria on these matters has been divergent, and in the course of his research, attorney Emanuil Kolev proposes a unified approach to resolving the examined issues.
Of particular significance is that alongside Bulgarian case law, the paper analyzes the jurisprudence of the French Court of Cassation. On this comparative law foundation, a more pragmatic and effective approach to interpreting the issues under consideration is proposed.
